The question we hear the most from people is “do I qualify for chapter 7 bankruptcy?” Bankruptcy courts and laws can be confusing to someone who hasn’t been through the process, especially determining eligibility thanks to the new bankruptcy laws. Curious if you qualify for ch 7?

Individual - In order to file ch 7, you have to be an individual, businesses are not eligible. You can be married or single. You can file with your spouse or without them. If you file without your spouse you will still have to disclose their income in order to determine if you are eligible to file chapter 7.

Income - Under the new bankruptcy laws chapter 7 filers must submit a bankruptcy means test which determines if you have the means, enough disposable income, to pay at least a portion of your debts. Your income is compared to the state median for a family of your size, if it’s below the median then you qualify for chapter 7.

You can provide your living expenses to qualify if your income is above the median. The means test will then compare your living expenses to the IRS standard allowances that have been set for where you live. You may also be able to include extraordinary expenses you may have due to medical and other conditions that will have to be explained to the bankruptcy court.

If your disposable income is lower than $6000 you qualify for ch 7, if it’s more than $10,000 you do not qualify for chapter 7 bankruptcy. If your leftover income is between $6000-$10,000 then you have to determine if you can pay at least 25% of your unsecured debt, if you can’t then you can file ch7. As you can see, the means test is confusing if you have disposable income because your income is higher than the median, so you should discuss your eligibility with a bankruptcy attorney.

It’s the final week in June and that can mean solely one thing. Wimbledon is present! It’s the 14 days in the calendar year where people begin to find their tennis rackets, find their whitest of whites and game the inevitable showers to exercise their back hand and volley. Man and Van Wimbledon is dedicated to supplying the most able and competitive service ready even when SW19 satiated with tourists. I have been finding a lot of great new blogs recently. I am unconvinced about all the twitter bustle. I still enjoy blogs and have a substantial number in my feed reader.

The cool thing about blogs is that you can find hidden jewels, and they are from people that actually like to put pen to paper.

Sure you can discover some cool souls on twitter. But, seriously, twitter is for masses with attention defecit disorder or who dont like to write genuine posts. Yes, bunches of people twitter and also blog, and those souls are chill by me, but I am invariably and eternally a blog fan.

Blogs pressure the author to actually articluate their judgement. Twitter by comparison merely allows you to express it. Call me old fashioned but I believe there is a point where smaller is no longer better. We have been obsessed with miniturization for so long. Peculiarly when it comes to technology. Surely there has to be a level where we recognise substance counts. Value matters. What do you think?

Possibly the proper answer rests in equilibrium. And compromise. You cannot force people to have marrow and not be superficial. But, too perhaps you need to drive the neo libral hippies to lighten up a little aswell?

Employers and workers alike are awaiting the House of Lords’ decision in the seminal case of Stringer v. HMRC, which will conclusively establish whether employees can continue to accrue annual holidays while they are on sick leave, and whether they can take further annual leave while on sick leave. UK law is currently interpreted to disallow employees from carrying forward unused leave from year to year, and from availing of annual leave while on sick leave.

Four erstwhile employees of HMRC began this long-running legal battle when they filed suit against the company - three of them for refusal to pay cash in lieu of unused holidays on termination while on sick leave, and one for refusal to allow him to take annual leave while on sick leave.

The case was heard by an Employment Tribunal and then by the Court of Appeal, both of which decided in HMRC’s favour. However, when it went to the European Court of Justice in January, it was held that the lower courts had incorrectly interpreted the relevant Regulations. The Court laid down a number of rules:

- Annual leave is independent of and unaffected by sick leave, if any, taken by a worker. Employees are entitled to four weeks’ annual leave each year, which can be carried forward if not availed at the end of a year;

- Employees have a right to take this leave upon return to work after sick leave;

- Upon termination, all unused leave is to be compensated for in cash payments; and

- Employers are to deal with not only contractual benefits such as sick leave, maternity benefits etc., but also with additional leave available to the employee under the Regulations.

The case has since then reached the House of Lords, from which a decision is soon expected.
